1. About U-Hire 2 Buy

U-Hire 2 Buy (also referred to as “U Hire 2 Buy”, “we”, “us” or “our”) provides equipment hire and hire-to-buy solutions for Australian small businesses, including tradies and other operators who need high-value equipment without tying up capital upfront.

Our website is intended to provide information about our services, allow you to express interest, submit applications and contact us. Availability of services is subject to approval, eligibility and the terms of your individual hire agreement.

2. Acceptance of these Terms

By accessing or using this website, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use this website.

If you submit an application or enter into a hire agreement with us, additional terms and conditions will apply to that arrangement. Where there is any inconsistency between these website terms and your hire agreement, your hire agreement will prevail to the extent of the inconsistency.

3. Website Use

You agree to use this website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the website.

• You must not attempt to gain unauthorised access to any part of the website, its servers or connected systems.
• You must not use the website to transmit harmful code, spam or misleading information.
• You must not copy, scrape, reproduce or republish substantial parts of the website without our prior written consent.

4. Applications & Eligibility

Applications for U-Hire 2 Buy services are submitted online through our paperless application process. Submitting an application does not guarantee approval.

As part of the application process, we may require your ABN, identity verification (including a copy of your driver’s licence), bank and credit card details, personal references and consent to conduct a credit check. You must provide accurate, complete and current information.

Approval is subject to our assessment criteria, including creditworthiness, business suitability and equipment requirements. We may approve, decline or request further information at our discretion.

5. Credit Checks & Fees

A credit check fee of $30 (or such other amount as disclosed at the time of application) may apply as part of the application and approval process. This fee will be disclosed to you before you proceed.

By submitting an application, you authorise us and our related entities to obtain credit reporting and other information about you for the purposes of assessing your application, managing your account and collecting amounts owed.

Credit reporting information is handled in accordance with applicable Australian privacy and credit reporting laws.

6. Payments & Hire Charges

If your application is approved, payment terms will be set out in your hire agreement. Unless otherwise stated in your agreement, the following general principles apply:

• When your contract is approved, your deposit and the applicable credit check fee may be deducted from your nominated bank account immediately — especially for custom orders when you sign a purchase order. When you take delivery of equipment, the first four (4) weeks’ hire fee may also be deducted as disclosed in your agreement.
• Regular weekly or monthly hire payments generally commence from the delivery date, once you have taken delivery of the equipment.
• All amounts are payable in Australian dollars unless otherwise agreed in writing.
• You are responsible for ensuring sufficient funds are available in your nominated account on payment due dates.
• Late or missed payments may incur fees, default interest or other charges as permitted by your hire agreement and applicable law.

7. Equipment, Delivery & Use

Equipment may be supplied directly by U-Hire 2 Buy or through approved partner suppliers. Delivery times, specifications and availability may vary depending on the equipment ordered.

You must use the equipment only for lawful business purposes, in accordance with manufacturer guidelines and your hire agreement. You are responsible for maintaining the equipment in good working order, subject to any maintenance obligations set out in your agreement.

You must not sell, assign, sub-hire, pledge or otherwise dispose of the equipment without our prior written consent.

Risk in the equipment may pass to you on delivery, as specified in your hire agreement. You should maintain adequate insurance as required under your agreement.

8. Hire Period, Return & Purchase

There is no obligation to purchase the equipment. Your hire arrangement is designed to provide flexibility for your business.

Unless your hire agreement states otherwise, after the first twelve (12) months you may continue to hire the equipment for as long as you wish, return the equipment (subject to return conditions), or explore purchase or payout options as offered under your agreement.

Early return, termination or payout may be subject to minimum terms, notice periods, outstanding amounts, return fees or other conditions disclosed in your hire agreement.

Equipment must be returned in the condition required under your agreement, fair wear and tear excepted.

9. Additional Payments & Credit

If you choose to pay more than your scheduled hire payment, the difference between the scheduled amount and your larger payment may be held in credit and applied against the payout or purchase of your equipment, as set out in your hire agreement.

Credit balances and their application are subject to the terms of your individual agreement and may not be refundable or transferable except as permitted by law or agreed in writing.

10. Tax Information

U-Hire 2 Buy structures its services to assist eligible small businesses access equipment in a cost-effective manner. References to tax benefits or tax-effective outcomes on this website are general in nature only.

Tax outcomes depend on your individual circumstances. We do not provide tax, accounting or financial advice. You should seek independent advice from a qualified professional before relying on any tax-related information on this website.

11. Partner Suppliers

Our website may feature or link to third-party partner suppliers, e-commerce sites or external websites. Those partners are independent businesses and are not agents of U-Hire 2 Buy unless expressly stated.

We are not responsible for the products, services, pricing, delivery or conduct of third-party partners, except to the extent required by law or expressly agreed in writing. Your dealings with partner suppliers may be subject to their own terms and conditions.

16. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services remedied if they fail to meet a consumer guarantee and the failure does not amount to a major failure.

These rights apply in addition to any rights under your hire agreement.

17. Governing Law

These Terms and Conditions are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of the state or territory in which U-Hire 2 Buy conducts business, unless otherwise required by law.

We may update these Terms and Conditions from time to time by publishing a revised version on this website. The “Last updated” date at the top of this page will reflect the most recent revision.
